1. Acceptance of Terms

By accessing or using AI Face Battle ("aifacebattle.com", the "Service"), operated by FaceBattle ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

2. Description of Service

AI Face Battle is an entertainment website that presents pairs of AI-generated faces and allows visitors to vote on them. Votes are used to calculate ELO-based rankings displayed on a public leaderboard. The Service may also generate a personal "type" profile based on your voting patterns. No user accounts are required. An anonymous voter identifier is stored in your browser's localStorage.

3. AI-Generated Content

All faces displayed on this site are 100% generated by artificial intelligence using generative adversarial networks (GANs/StyleGAN). No real persons are depicted. Any resemblance to actual persons, living or deceased, is entirely coincidental and unintentional. We make no representation that any AI-generated face corresponds to, is based on, or is derived from any real individual.

4. Age Restriction

The Service is intended for users aged 16 and older. By using the Service, you represent that you are at least 16 years of age. If you are under 16, you must not use this Service. We chose this threshold in accordance with Swiss data protection law (nDSG) and the EU General Data Protection Regulation (GDPR), which set the age of digital consent between 13 and 16 depending on jurisdiction.

5. Acceptable Use

You agree not to:

  • Use automated scripts, bots, or other tools to cast votes or manipulate rankings
  • Attempt to reverse-engineer, scrape, or systematically download the AI-generated images or any other content from the Service
  • Interfere with or disrupt the integrity of the voting system, leaderboard, or any part of the Service
  • Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law
  • Misrepresent any AI-generated face as a real person, or use images from this site to create fake identities, deepfakes, or for fraudulent purposes
  • Attempt to gain unauthorized access to our systems, servers, or databases

We reserve the right to block access to the Service for any user who violates these terms, including by IP address or other technical means.

6. Intellectual Property

The website design, source code, branding, logos, and text content are the property of FaceBattle and are protected by applicable intellectual property laws. The AI-generated face images are created using publicly available generative AI models. Due to the nature of AI-generated content, copyright ownership of individual AI-generated images may be limited or non-existent under current law. You may not reproduce, distribute, or commercially exploit any content from this Service without our prior written consent.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, FaceBattle and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed CHF 100 (one hundred Swiss francs).

9. Advertisements and Third-Party Content

The Service may display advertisements or links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party sites or advertisements. Your interactions with third-party advertisers are solely between you and the advertiser. We are not liable for any loss or damage resulting from such interactions.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our data practices.

11. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Continued use of the Service after changes constitutes acceptance.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the substantive laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts at the registered domicile of FaceBattle in Switzerland.

If you are a consumer resident in the European Union, you retain any mandatory consumer protection rights granted under the laws of your country of residence, and nothing in these Terms affects your right to rely on such provisions.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
